Sermon brings legal logic to biblical counsel

Tomorrow morning, Sunday, September 28, I will have the privilege of speaking to North Scituate Baptist Church (NSBC) in Rhode Island about Hebrews 13:5.

The verse (NIV) reads:

Keep your lives free from the love of money and be content with what you have, because God has said, "Never will I leave you; never will I forsake you."
I hope to share some legal logic with the congregation, breaking down the verse as a statement of causation. I'll also describe how I found evidence of the verse's causal truth when I traveled to one of my favorite places in 2020, Ghana.

Iglesia celebra ordenación en comunidad quechua

En mi iglesia de Rhode Island el domingo, fuimos testigos de la ordenación de Gabriel Zhulleima.

Barrington Baptist Church (BBC) dio la bienvenida a la gente de varias iglesias, de Massachusetts y el estado Nueva York, tan lejos como Albany. Las iglesias que se unieron con nosotros incluyen en particular la gente Quechua que viven en esta región. Un grupo de mujeres quechuas honró el evento con una actuación musical en la tradición indígena.

Nuestro propio pastor y misionero Aurelino Cruz, de origen brasileño, sirvió como maestro de ceremonias y traductor del español al inglés. El pastor y misionero Antonio DeLaZerda dío el mensaje, o sermón, a la iglesia en español. Cruz y DeLaZerda ambos sirven con la organización Missions Door.

En el mensaje, Pastor DeLaZerda dijo que lo que describrió como la forma en que América está "cambiando" el mundo crea un problema para cristianos. No dio más detalles, y no quiero atribuirle mi propia interpretación. Pero yo también he tenido inquietudes sobre la incompatibilidad entre la política exterior estadounidense y las enseñanzas de Jesús.

Esto no significa que la religión deba dictar políticas. Pero la ayuda exterior es el motor del "evangelismo" estadounidense sobre la democracia y el estado de derecho. Terminación arbitraria de la ayuda está diezmando nuestros objetivos políticos, a la vez que cobra un precio horrendo en sufrimiento humano. A veces, lo que enseña la Biblia es simplemente bueno juicio.

Christian law students hear advice on grounding oneself in faith amid stresses of law practice

The newly constituted student Christian Legal Society at UMass Law School held its first event on St. Patrick's Day.

In a hybrid meeting, "Faith and the Legal Field," CLS students in Dartmouth, Mass., and I were joined via Zoom by Anton Sorkin, director of law student ministries at the Christian Legal Society in Springfield, Va.; attorney J.A.A. Purves, Penner & Purves, Santa Barbara, Cal.; and Kathy Cooper, InterVarsity regional director for faculty and graduate ministries, working out of Brown University in Providence, R.I.

The new student organization and this panel in particular were the work product of the tireless Tiffany Trott-McKenna and her executive board, Sophia Chiotis, JuliaBianca Josen, Dream Whitaker, and Paul Steinman. They're all wonderful students whom soon I will miss when they graduate and begin law practice.

A veteran of the U.S. Marines, Trott-McKenna is a phenom I have been especially privileged to know in her time in law school. She serves also as president of the Black Law Students Association and member of the Veterans Law Association, and she will practice law in California after graduation.

Trott-McKenna asked the panelists to share their experiences with faith and law practice, and also asked for takeaways that might be useful as Christian law students transition to practice.

Purves talked about family practice and explained, for example, the distinctly professional role of the lawyer in a divorce case. Both faith and one's professional responsibility call for compassionate and informed counseling of a client seeking divorce, he said—even though marital reconciliation will spell the early end of the representation.

Sorkin spoke to the challenges of practicing in Big Law while maintaining ethical and moral lines, dictated by faith, that one won't cross. Constant vigilance and self-interrogation are required to resist the "win at any cost" mentality that too often dictates legal maneuvering. I'm reminded of Daniel 6:3.

For my part, I spoke of the temptation to bifurcate one's life into faith and secular work, and how I came to understand that no one, lawyers included, truly lives a life of faith while indulging that duplicity.

In takeaways, Cooper spoke to the importance of prayer to keep an even keel. Likewise, I talked about the importance of staying in the Word—while admitting that my track record isn't perfect, as daily struggles inevitably pull us all toward materialism and the secular. The important thing is to try, try again.

Trott-McKenna succeeded magnificently in navigating the bureaucracy to obtain official recognition of the CLS student group at the law school and in the university. I have been blessed to serve as the inaugural faculty adviser for the CLS group.

The group is not yet an official chapter of the national CLS organization. That will be a job for an up and coming new board. I look forward to CLS contributing vitally to the formation of law students' professional identity in the coming years.

Amos, King: love one another; defend the oppressed; plead the cause of the innocent, the powerless

On this Martin Luther King, Jr. weekend, I was blessed with the opportunity to stand in the pulpit of the historic North Scituate Baptist Church, Rhode Island, affording a rest for beloved Pastor Kim Nelson there.

I spoke to the Book of Amos, chapter 5, verses 21 to 24 (NIV), often cited by Dr. King. In the "I Have a Dream" speech on the steps of the Lincoln Memorial in August 1963 (photo), Dr. King quoted Amos 5:24: “[L]et judgment run down as waters, and righteousness as a mighty stream" (KJV).

In the history of the church, Amos at times has been controversial for its ominous depiction of God. But Amos contains a call for social justice that is as important and relevant today as it was in America during the Civil Rights Movement and in Israel in the 8th century B.C.

My wife and I are deeply grateful to the people at North Scituate for their warm hospitality.

'Repay evil with blessing,' Apostle Peter writes

With Election Day tomorrow, this might be an opportune moment for a message of peace and non-retribution.

Last week I had the privilege of sharing the word of 1 Peter 3:8-9 at the nearby Rhode Island church of a dear friend and pastor while he was away from the pulpit. (Oct. 27, below.)

Finally, all of you, be like-minded, be sympathetic, love one another, be compassionate and humble. Do not repay evil with evil or insult with insult. On the contrary, repay evil with blessing, because to this you were called so that you may inherit a blessing.

The pastor had preached the preceding week on the flaws of human criminal justice. So I started by shifting the focus to civil justice and the fundamental question, as framed by my late friend and mentor Professor Marshall S. Shapo, A injures B and could have avoided it; what should society do? 

Professor Shapo was well schooled in the Old Testament and knew the teaching of Exodus, an eye for an eye. The New Testament put another spin on the problem and confronts the contemporary Christian litigator with a vexing challenge. 1 Peter 3:8, et seq., is only a piece of the solution, and I don't purport to have it all worked out. Nevertheless, and at risk of some hypocrisy, I found a starting point in the verses.

I thank the pastoral and worship teams and congregation of North Scituate Baptist Church, Rhode Island, for their kindness, hospitality, and indulgence of my ramblings, which I hope were motivated by the Spirit. (Full service.)

Religious talk touches on Jewish law, legal writing

On Sunday, I had the privilege of delivering the message at my home church, in Barrington, R.I., regarding Psalm 121.

There is a bit to do with law. I talked about the Hebrew word shomer, which along with the related verb yishmar is used in some form six times in Psalm 121 to describe God as a watchman or guardian. The term has particular application in Jewish law, referring to the person who watches over the body of the deceased until burial, and to the person who is responsible for ensuring kosher standards in a kitchen.

I talked also about the merism, the literary device by which a writer cites two extremes to incorporate everything in between as well, or to two contrasting parts to refer to the whole. The merism is employed repeatedly in Psalm 121, for example in referring to the same "heaven and earth" described in Genesis 1:1.

Legal doublets, usually of historical origin, can be merisms. In the sermon, I used the examples of "cease and desist" and "aiding and abetting." But on further reflection, I don't think they're great examples, because the words are not so clearly contrasting. A better example would be "last will and testament," because the term once referred to two discrete documents, disposing of real and personal property, respectively. The merism thus signals that the instant document represents the whole of the testator's intentions.

Legal writers often are admonished to trim duplicative doublets, especially when the words are mere synonyms, lest they be misconstrued as narrowing specifics. But the imperative of clear and succinct writing sometimes should give way to the value in a term of art, which incorporates an established meaning, and in a true merism, which conveys the meaning of expansive entirety.

Daggett discovered higher ed, world in senior life

Olive Daggett died on December 21, 2023, at the age of 96.

Olive was a friend, a leader in my church, and an astounding human being. Her passing was marked at Legacy.com and by The Providence Journal. Her memorial service last weekend at Barrington Baptist Church in Rhode Island is posted at Vimeo.

I memorialize Olive here at The Savory Tort because she was inspiriting in ways especially relevant to my personal and professional interests in education and internationalism.

For 40 years, Olive had a full life and worked a career in accounting for AT&T in New Jersey. Yet she had another life ahead, even before the eternal one. After retiring, she moved to Rhode Island. And then she enrolled at the University of Rhode Island and earned a four-year bachelor's degree.

Moreover, in the course of her university studies, as a senior, Olive studied abroad. She discovered a love for the world, twice studying in England and traveling on the continent. At Barrington Baptist Church, Olive gravitated to foreign missions. She became the church's missions secretary and coordinated missionary efforts globally for decades.

Faintly visible in the ProJo photograph, a pink- or purple-dyed streak ran through Olive's silver hair. Pastor Scotty Neasbitt recounted that Olive adopted the color in part to help her relate to youth in the church. Either it worked or she never needed any help; she was adored by all ages. Something about her genial character and zest for life made her transcendent of generations.

My wife and I were fortunate to have been able to visit with Olive when she was in hospice care in December. She was her usual jovial self. Secure in her faith, she had no fear of her mortal end. In so many ways, she was, and for all who remember her will remain, an inspiration.

Ethics problems in law, education inform message on Christian ethics in biblical story of widow's offering

Last Sunday, it was my privilege to deliver a message on "Christian ethics," arising from Mark 12:41-44, at my local church in Barrington, R.I.

The service is posted on the church website. The message begins at about 31 minutes and runs about 24 minutes in duration.

I used two problems in conventional ethics as jumping off points: one, from legal ethics, a lawyer's unintentional acquisition of privileged records produced mistakenly in discovery; and two, from higher education, a student's unintended acquisition of an unfair academic advantage.

I used the term "doing ethics," which I borrow from, though it is not unique to, the work of Bob Steele (no relation), Jay Black, and Ralph Barney, with a powerful assist by Lou Hodges, in journalism ethics in the 1990s. I was privileged to have a front-row seat when they worked out the revised code of ethics for the Society of Professional Journalists at that time, especially the game-changing "Minimize Harm" principle.

In crafting the church message, I am indebted especially to mentors Eric D'Agostino and Scotty Neasbitt, who helped me navigate the research; and to my church leadership, including Dan Harrington, who writes thought provokingly for the ProJo; and, always, to my wife, an unflinching editor.

I note that, as always, this blog is personal and not affiliated with nor controlled by my employer.
