Rescission of law dean offer prompts valid angst, but political ire over higher ed impunity is long time coming

Legal academics is aflutter over the rescinding of an offer of the deanship at the law school of the University of Arkansas, Fayetteville, to Emily Suski, a law professor at the University of South Carolina, upon pressure from conservative politicians.

I've lately been cited and quoted on the matter, partly because I lived and worked as a law professor in Arkansas for thirteen and a half years, until 2011. I'll say a bit more here.

The Suski story has been much in the news, from The Arkansas Times to The New York Times, and has been framed by our present era of political strife. The rescission was motivated by conservative state lawmakers apparently unhappy over leftward leanings in Suski's record as an academic and a lawyer.

I am not opining, and have not opined, on the rescission in sum, because I don't know what was in the minds of lawmakers and the university president. I have made no study of the record. I said as much to Arkansas Democract-Gazette (ADG) reporter Neal Earley late last week. If you want a view from the ground, my colleague Robert Steinbuch, law professor and columnist, talked about the matter toward the end of this interview with KATV (cue to about 2:05).

I did tell the ADG, where I was fairly represented in a story Monday, to which Earley contributed, that I have First Amendment concerns if, and insofar as, the political decision was motivated by retaliation for viewpoints expressed in litigation or academic work. I agree with a statement of the president of the Arkansas Bar Association that a lawyer should not be discriminated against by a public entity for employment based on positions taken in prior litigation.

But the matter is not that straightforward.

Some Arkansas politicians are vexed by Suski's sign-on to an amicus brief in the SCOTUS-bound transgender athlete case, on the side of the athlete challenging West Virginia law. Some might be displeased with her support for the U.S. Supreme Court nomination of now-Justice Ketanji Brown Jackson. A single, clear rationale for rescinding has not been articulated, and likely, motivations are varied.

I have authored, contributed to, and signed amicus briefs myself, I told Earley, in support of principles notwithstanding the position of litigants. For example, my amicus positions on the freedom of information have aligned me with affirmative action skeptics and animal rights activists. Whether, or to what extent, I agreed with the litigants' many public positions was immaterial to my advocacy for transparency, accountability, or civil liberties in the matters at hand.

I'm not shy with my opinions. But if you want them, the responsible thing is to ask, not assume. The world is gray. My own views have nuance. I'm sure Suski's do too.

At the same time, this story ought not be framed merely in terms of contemporary partisanship. I told the ADG that I understand lawmakers' reaction in "a broader context of long-time suppression of (the conservative) viewpoint in legal academics."

That's true. Earley asked for examples, and I gave him several. I've done work with the Federalist Society and with the Heritage Foundation. I supported law students at the University of Massachusetts Law School in establishing a Christian Legal Society (as yet not an official chapter).

That doesn't mean I agree with every position taken by those organizations. (I'm not alone.) It does mean that I have over the years left those groups off my CV when applying for this or that in legal academics, because their mention would have killed my application. At the same time, I have never felt compelled in legal academics to conceal association with the AAUP or the ACLU. Those alignments are badges of achievement.

I didn't make the rules, and I don't approve of them. This is the world as I found it. Having had some privileges and not others while trying to advance my academic career, I have not buried my head in the sand about unjustified biases. For legal academics now to be wringing their hands over censorship of left-leaning causes might be justified in the instant case, but implicates more than a little hypocrisy.

One quote of mine in the ADG story was right, but could benefit from context: "I feel almost a bit of relief to say that thank heavens someone is paying attention." That sounds, erroneously, like approval of the politics of the Arkansas legislators in the Suski case, contrary to my refusal only a sentence earlier in the story to state approval or disapproval.

Rather, I made that statement in discussion with Earley of a different point, namely, that legislators in Arkansas, in other states, and in Washington, D.C., have abdicated their responsibility for the accountability of public institutions, especially in higher education. Regardless of the merits of the decision in Arkansas, the idea is refreshing that Arkansas legislators would hold the University of Arkansas to any standard at all. 

In my experience in Arkansas, the university, a political behemoth, did not hesitate to throw its weight around at the capitol. And legislators kowtowed to its will. For example, legislators, with few noteworthy exceptions, happily parrot the fiction that the filthy-rich university foundation is a private entity properly immune from the state freedom of information act, though in fact, public officials dictate how the money is spent.

When I spoke to Earley, I was not thinking about Arkansas legislative accountability in any matter of my personal interest. But maybe I should have been.

For The Arkansas Times blog, Dr. Walter Kimbrough opened an opinion piece with reference to a lawsuit I brought almost 20 years ago when working in Arkansas. Kimbrough is a former president of two HBCUs and now an executive vice president of the UNCF (the "United Negro College Fund," though the organization usually uses just its initials nowadays). 

I'm flattered that Kimbrough, whom I greatly respect, remembers my case, the best account of which was penned by the great Scott Jaschik, who retired in 2023, and can be read still at Inside Higher Ed.

Kimbrough's headline highlights the "cancel culture" angle in the Suski story. Invocation of my case shows that what happened to Suski is not new, because it happened to me—even if the shoe was on the other foot, from a conventional political perspective.

At least my takeaway from Kimbrough's comparison is be careful what tactics you use, because it won't feel good when they're turned against you. If abstracted to politics, it's basically the same logic justifying humane treatment of war prisoners, not because you're worried about the enemy, but because you're worried about your own. Regardless of who fired first, conservatives who once lamented the victimization of cancel culture now look hypocritical when they engage in it.

Not necessary to his thesis (and maybe undercutting it?), but salient to me, Kimbrough observed that no Arkansas legislator cared to intervene when I was "canceled." Don't I know it. The same can be said for organizations from the AAUP and ACLU to FIRE and the National Association of Scholars. Crickets for an embattled professor in flyover country. Again, this is not what I was thinking about when I talked with Earley, but it does bolster my point about accountability.

Kimbrough mentioned that I dropped that Arkansas lawsuit. He might have added that I received, as Jaschik reported (same article), a complete exoneration of any wrongdoing by the law school in Little Rock—which is what I had asked for all along.

Some people have asked me privately, don't I feel bad for Emily Suski?

Of course I do. Everyone should. She was a victim in all of this. Yes, the law school's offer letter did say the offer was contingent on university approval. But offer letters contain all kinds of boilerplate qualifiers. For all intents and purposes, Suski was instructed, publicly, to pack her bags. And then she had the rug pulled out from under her.

But while we feel bad for her, let's also place blame where it belongs. That's not just with politically motivated legislators, but with leaders in public academic institutions, who have long acted with impunity, abusing legislative deference and elevating their own agendas and preferences above their responsibility to the taxpayer.

From national TV to local school, suspension of dissenters evidences worrisome speech suppression

Free speech is in danger in the United States, and two recent matters, one national and one local to me, are representative and worrisome.

The national story is the suspension of Jimmy Kimmel from his late-night talk show on the ABC television network.

Where Kimmel apparently crossed a red line with ABC parent Disney was his equation of the accused assassin of Charlie Kirk with the America-first MAGA movement. The comment stoked right-wing ire, and Kimmel was accused of inciting or supporting political violence—an inferential leap he did not make. In the light of day, I find Kimmel's comment in poor taste. But he did not advocate for political violence. 

I support the prerogative of Disney, as a private creative company—subject to procedurally proper and viewpoint-immaterial business regulation, such as antitrust law, which has been under-enforced in the administrations of both parties—to make decisions about what content it wishes to broadcast. But as in the case of cancelled late-night host Stephen Colbert, the decision here is not about reasoned disagreement, rather is about capitulation to government threats to use state power unlawfully and unconstitutionally.

Circumstances strongly suggested that Colbert's Late Show was canceled because of government threats to use the Federal Communications Commission (FCC) broadcast licensing authority to block the merger of CBS parent Paramount with media company Skydance. But it was difficult to find direct rather than circumstantial evidence of the connection between the government and Paramount.

No longer. FCC Chairman Brendan Carr plainly threatened to use FCC power to attack Nexstar, the company that owns a great many ABC affiliates that carry Disney content. Nexstar and Disney are said to be courting, and Nexstar has a history of dissatisfaction with FCC regulation that would stymie the growth of its media empire. So the FCC threat to Nexstar was taken to heart in the boardroom, The Wall Street Journal reported, and became a threat to business partner Disney, in turn. 

Curious how the anti-regulatory right is suddenly interested in a strong administrative state.

The problem here is that censorship of political content, that is, political viewpoint discrimination, is not a legitimate basis for the FCC, nor most any governmental authority, to flex its muscle in interference with the private market. The closest Carr came to a legitimate rationale for FCC retaliation was the assertion that programming such as Kimmel's perpetuates false information. 

Yet even if that were a proper basis for government intervention—arguable, depending on the nature of the information alleged false—there is no evidence that false assertions of fact by Kimmel or anyone else motivated Carr's threat. Whatever one thinks of Kimmel's appraisal of the Kirk murder, or of MAGA, he uttered only opinion.

Incidentally, President Trump's lawsuit against The New York Times Co. this week evidences the same disregard for the difference between fact and opinion. The voluminous complaint is rife with allegations that establish a difference of opinion, but precious few claims of false assertions of fact. So over the top is the complaint that it evidences the abject failure of the legal profession to regulate itself as a profession. (UPDATE, Sept. 19: Did I underestimate the profession? See Trump v. To be clear, if Disney wants to suspend Kimmel because executives don't like his politics, fine. I might worry about whether antitrust law is enforced with sufficient vigor, or simply whether our media infrastructure is sufficiently healthy, that Americans have access to a wide range of viewpoints through audiovisual media. But my worries would not warrant interference with a business owner's political prerogative.

My objection here is to the threatened abuse of power by the FCC. A broadcast regulatory authority picking who may and who may not have access to media channels based on the broadcaster's support for the ruling regime is naked and shameful authoritarianism.

And then there is the local.

In my community of Barrington, Rhode Island, a teacher, Benjamin Fillo, has been suspended from Barrington Public Schools for his TikTok comments about Charlie Kirk.

Once again, I find the speaker's comments in poor taste. According to The New York Post and to WLNE—an ABC affiliate which, incidentally, recently became the second local news broadcaster under the control of the right-wing-disinformation-associated Sinclair group, somehow without provoking FCC regulatory objection—Fillo called Kirk a "piece of garbage" and accused him of hatred for the LGBTQ community and hostility to women's rights and democracy.

Like Kimmel, Fillo did not advocate for political violence. I would like him to have condemned it. But that preference is mine.

Also, as a parent in this community, I am sympathetic to parents' concerns that the public school be a place of neither ideological indoctrination nor ideological marginalization.

What worries me here is that Fillo's speech occurred on TikTok, outside the school, outside his capacity as a teacher, at least insofar as has been reported. His video seems to have effected no "material and substantial disruption" of the schoolhouse, to use the probably applicable constitutional language, other than disruption by people who self-servingly would claim disruption.

The school district has hired an independent investigator. Sounds a bit Orwellian, but better than a summary firing. What's concerning is that, again, as far as I have seen reported, the investigation is based only on extramural speech, and worse, Fillo was placed on administrative leave for his extramural speech. So already he's been singled out and penalized upon no apparent evidence that he poses any threat to students.

When my daughter was a minor in Barrington schools, she had teachers with whom I disagreed, and with whom she disagreed, politically, and who had different religious beliefs from mine, and from hers, just like I have law students who have different opinions and beliefs from mine. The appropriate pedagogy, which my daughter's teachers employed, and which I endeavor to employ, albeit in the different context of graduate school, is to equip students to disagree. It's not an easy line to draw, but that's the job of a teacher.

What does not work, what I would not want from my child's teachers, and what I try not to do in the classroom, is to pretend to be some kind of politically neutered Ken doll incapable of forming a personal viewpoint. That's what no teacher should model for students. Yet that seems to be what Barrington schools, and too many parents, want to see.

That Fillo has opinions outside the school, whether or not I agree with them, whether or not students and parents agree with them, suggests to me only that he is a good teacher, because he is a whole and thinking human being. If he had no discernible political views, I would wonder whether he were competent to teach social studies.

The takeaway from both these matters seems to be that our society is suffering a worrisome intolerance for disagreement.

It's becoming cool and normal for government to use its power to enforce group-think—a place I thought the right promised to move us away from. And it's becoming cool and normal for employers, even public employers, to capitulate to demands that group-think be enforced, or at least that dissent be suppressed. 

The marketplace of ideas is a flawed metaphor. But it's not all wrong. What I know for sure is that ours should not be a country in which the marketplace of ideas sells only one kind of bread, and everyone must get in line for it.

Boston flag scrap heads to Washington

A Boston First Amendment flag-flying case is Supreme Court bound.

The case centers on three flagpoles at Boston City Hall.  The city flies the U.S. flag and POW/MIA flag on one pole, the Massachusetts flag on the second, and usually, the city flag on the third.  However, the city occasionally replaces its own flag with another.  The city refused a request by Camp Constitution, a religiously oriented civic organization, to fly the Christian ecumenical flag.

The First Circuit, affirming the district court, ruled for the city.  The court applied the government speech doctrine, holding that the third flagpole was reserved for the government's own speech, not opened as any kind of public forum for private speech.

The decision was supported by the testimony of city commissioner George Rooney, who said that he reviewed applications for flag raising for "consisten[cy] with the City's message, policies, and practices." The city moreover relied on its own First Amendment obligation not to establish religion.

Camp Constitution maintains that the application process expressly dedicates the flagpole as a public forum, so the First Amendment public forum doctrine should pertain.  In a public forum approach, the appellant reasons, exclusion of the ecumenical flag would be an impermissible discrimination against a religious viewpoint.

As the parties' positions demonstrate, the line between government speech doctrine and public forum doctrine is not always bright.  The government has the power to utter its own messages; think of Nancy Reagan saying, "Just Say No," or President Biden telling people to get vaccinated.

But when government opens a forum for public participation, its ability to censor within the forum is limited to setting the parameters of the forum.  Censorship of messages based on content must satisfy heightened First Amendment scrutiny, and censorship based on viewpoint is generally disallowed.  The paradigm is a bulletin board in a city park where the public is invited to post flyers.

Forums can be metaphysical, too.  Public forum doctrine was employed to limit President Trump's ability to excommunicate Twitter followers.  Tumultuous litigation over vanity license plates in the states have tugged back and forth across the government speech-public forum line, depending on how the government sets up the program.

The problem here is in large part of the city's own making, because, the First Circuit told us, "the City had no written policy for handling flag-raising applications. What is more, Rooney had never before denied a flag-raising application."  So Rooney was processing "applications," when "applications" were not really a thing.

Three months after Camp Constitution initiated litigation, the city adopted a written policy.  The first rule of the policy, on which the city now relies, "forbids the 'display [of] flags deemed to be inappropriate or offensive in nature or those supporting discrimination, prejudice, or religious movements.'"

The city's position is not helped by its history of flying a lot of flags.  The court recounted:

In a twelve-year period (from June 2005 through June 2017), the City approved 284 flag-raising events that implicated its third flagpole. These events were in connection with ethnic and other cultural celebrations, the arrival of dignitaries from other countries, the commemoration of historic events in other countries, and the celebration of certain causes (such as "gay pride"). The City also has raised on its third flagpole the flags of other countries, including Albania, Brazil, Ethiopia, Italy, Panama, Peru, Portugal, Mexico, as well as China, Cuba, and Turkey. So, too, it has raised the flags of Puerto Rico and private organizations, such as the Chinese Progressive Association, National Juneteenth Observance Foundation, Bunker Hill Association, and Boston Pride.

The city balked, it said, when faced with a first request to fly a religious flag.  The city believes that distinction bolsters its position in consistent policy and anti-establishment.  The same fact supports Camp Constitution's position, that the city is impermissibly hostile toward religion.

Flag controversies have been raging across the country.  My own hometown of Barrington, R.I., was rent in factions when, after a racially charged confrontation between residents, the town manager flew the Black Lives Matter flag at the town hall.  The United Veterans Council objected to what it perceived as diminution of the U.S. flag.  Like in Boston, the controversy was fueled by the town's lack of a policy.
