Global summit in business leadership moves online, examines US-India ties in aftermath of pandemic


The annual world summit "INBUSH ERA 2022" will be virtual this year, February 23 to 25, and host Amity University is maximizing the advantage of the digital platform with a truly global program.

This year marks the 22nd installment of the International Business Summit & Research Conference (INBUSH ERA). The year's theme is "Nurturing People, Purpose, Partnerships, Planet & Performances for Creating Sustainable World Class Organizations." Host Amity University is a prominent network of private universities in India, and the conference will be online and hybrid, based at the university's flagship campus at Noida, Uttar Pradesh, near Delhi.

Yesterday I had an organizational call with my colleague Professor Marut Bisht, who is elbow deep in planning academic components of the conference.  I look forward to offering a perspective on transnational communication regulation on a U.S.-focused panel beginning on Thursday, February 24, at 1330 GMT.  The same panel will recognize and welcome remarks from:

Indigenous people battle extractive industries, government in Constitutional Court of Ecuador

A case inching forward in Ecuador's constitutional court pits indigenous people against extractive industries and the government over the fate of the country's vast eastern jungles.

Among the many issues on which President Joe Biden and West Virginia Senator Joe Manchin disagree is the Keystone XL Pipeline Project.

The President blocked Keystone first thing in January 2021. Environmentalists and indigenous peoples' advocates long ardently opposed the project, though as fuel prices rose in recent months, Senator Manchin was among those renewing criticism of the termination.

Meanwhile, an environmental battle implicating extraction and with arguably more precious real estate in contention is playing out in the Constitutional Court of Ecuador.  In mid-November, the court heard the first in a series of oral arguments over a bid by the Kichwa indigenous people in the eastern Sarayaku region to reclaim control of the jungle and repel extractive industries working at the behest of the government.

There are many facets to the Kichwa's struggle.  The government has for decades promoted drilling, mining, and logging in eastern Ecuador, denigrating environment and inflicting injury with the introduction of explosives and toxic run-offs.   Emily Laber-Warren wrote a concise history for Sapiens in April.  The Kichwan spiritual angle is the focus of a short but more recent piece in Ñan. Indigenous people have won cases in the Inter-American Court of Human Rights, as long ago as 2012, and in the the Ecuadorean courts, but not always to any avail with the government.

A compelling aspect of the present dispute in the Ecuadorean courts is that the issues overlap with the environmental disaster left behind at Lago Agrio by Big Oil actor Texaco, later Chevron, memorialized in the 2015 book by Paul Barrett, Law of the Jungle.  The Chevron-Ecuador saga and the related prosecution, critics say persecution, of American attorney Steven Donziger continue to make headlinesI'm still waiting for the Hollywood retellings.

Lago Agrio is 217 km north of Sarayaku; that distance says something about the scope of the slowly unfolding tragedy.  I've assigned Law of the Jungle yet again for my spring 2022 Comparative Law class.  I keep waiting for the story to take some major turn, ideally an environmentally sound one, that renders the Barrett book intolerably outdated.  Yet most of what Barrett wrote about the long jeopardy of eastern Ecuador, and the failure of rule of law within the country to respond, remains true today.

I've not been able to find a dispassionate assessment of the November hearings, but plaintiff-friendly Amazon Frontline (AF) covered the day's events.  As AF observed, the hearing followed just days after the Glasgow climate change agreement was concluded.

Implicated collaterally in the case is the emerging legal theory, "rights of nature."  My friend and colleague Dr. Piotr Szwedo, lead editor of Law and Development and a member of the law faculty at Jagiellonian University in Poland, visited Ecuador this year and is conducting ongoing research into the legal implications of the rights of nature.

Sheriff FC tells two tales, because that's football, life

Coincidentally, I've lately been sporting my "Sheriff" ball cap.  I wrote about Transnistria after my visit there, and to Sheriff's 12,000-seat stadium in Tiraspol, two years ago: "Breakaway state of Transnistria might model new Russian sphere of influence" (Dec. 16, 2019).

It's interesting to see how media outlets describe Sheriff's geographic home.  Most I've seen say "Moldova," which, I guess, is what you find if you look at a political map.  Wikipedia describes Tiraspol as "the capital of Transnistria, a breakaway state in Moldova."  Only in an Al Jazeera main headline did I see exclusive mention of Transnistria.  The subhede then started, "Football club from a pro-Russian separatist enclave in Moldova."

After I crossed into Transnistria and showed my papers to the heavily armed border guards to get my 24-hour visa in a flurry of stamps, I didn't feel like I was still in Moldova.

Most media outlets have not picked up the political thread on the upset story.  In one exception, Sheriff's road to Champions League glory is well contextualized by Gab Marcotti for ESPN FC.  He observed that none of the Sheriff players are Moldovan or Transnistrian—but before one "get[s] high and mighty about national identity, please consider that at the final whistle, there were exactly zero Spaniards on the pitch."

Is the Sheriff-over-Real-Madrid story "a 'fairy tale' or a sad reflection"? Marcotti wondered.  On the one hand, there is the peculiar joy of football as sometimes, or seeming, social leveler:

Let it be a reminder that ordinary players, on an ordinary Tuesday night, can walk into the temple of football and knock it down, like Samson back in the day. That's part of the appeal of this sport. It's low-scoring, it's mano-a-mano, and the gap between superstars and extras may be huge over time, but on any given day, it can be tiny and anything can happen.  

Marcotti drew on a Twitter thread from near-Tiraspol-born, ethnically Russian, now Baltimore, Md.-based sportswriter Slava Malamud to illustrate the other hand:

[Sheriff] have been Moldovan champions in 19 of the past 21 years, they have the country's only modern stadium and they're bankrolled by the Sheriff corporation, a conglomerate that includes Transnistria's only supermarket chain, gas station chain, telephone network, TV channels, publishing house and distillery. The owners have close ties to the local government, which, in turn, is funded and protected by Russia. This isn't just a company team; it's a company town in the company enclave of Transnistria, and you can't shake the feeling that this is what it takes for "fairy tales" like this to take place in the modern game.

Football is metaphor.  What happens on the pitch, especially when recounted by capable journalists, is contradiction, because contradiction is football, and football is life.  Sheriff is fairy tale and sad reflection.  In the same way that pride and frustration are fast friends.

Undefeated in the group stage, Sheriff now leads UEFA Champions League Group D with wins over Real Madrid and Ukraine's Shakhtar Donetsk.  Sheriff will face Inter Milan, in Milan, on October 19, again putting the fairy tale to the test.

U.S. State Department dabbles in gamer diplomacy

The U.S. State Department announced in April that it will sponsor 10-week virtual student exchange programs to connect teens from the United States, Bahrain, Israel, and the UAE to collaborate in developing "social impact video games."  "Game Exchange" is part of a State Department grant award to Games for Change, a Woodside, N.Y.-based nonprofit that, by its own description, "empowers game creators and social innovators to drive real-world impact through games and immersive media."  Game Exchange aims to reach 3,000 middle and high school students over two years by pairing classrooms across borders.  I am a believer in "sports diplomacy" by the State Department and in the related work of organizations such as Soccer Without Borders, so I guess I should get behind this STEM equivalent.  Read more at Games for Change or at The Washington Post (bafflingly not pay-walled at last check).  Hat tip to Jennifer Batista at IP Media Law and Updates from New York City-based Frankfurt Kurnit Klein & Selz.

What goes around comes around: U.S. election cycle, Capitol riot draw 'banana republic' gibes

Seth Doane has an excellent piece out today (Facebook, YouTube, and embed below) on foreign perspectives on the Capitol riot, insurrection, whatever: rebellion to be named later.  The story mentions the Kenyan headline, "Who's the banana republic now?"  I wish only to add that it's not the first time for such cheekiness, recalling Colombia's Publimetro cover from November 6 (Guardian).  I've no doubt that there are plenty of "s***hole" gibes going on in Africa, too.

Tort liability brakes U.S. policy shift on Sudan, marks crossroads of past, future where Africa meets Arabia

With economic sanctions exacting an intensified toll amid the pandemic and humanitarian crises fraying the peace at political borders, 40 million people in the East African Republic of Sudan may hope that long awaited normalization of relations with the United States will bolster stability and produce prosperity.  Meanwhile, in Washington, American tort claims have thrown a wrench into the diplomatic works.

Unending War

Before its 2011 division into north and south, Sudan was the largest country in Africa.  Its location is strategically important.  Sudan borders Libya and Egypt to the north, the lifeline of the Nile flowing into the latter.  The country's Red Sea coast positions Port Sudan opposite Jeddah and Mecca.  Chad and the Central African Republic (CAR) sit to the west, and Eritrea and Ethiopia to the east—where more than 40,000 Ethiopian refugees have fled conflict and now strain Sudan's thin resources.  Tumultuous northern regions of the Democratic Republic of the Congo (DRC) and Uganda, the latter yielding the Nile, lie in reach of South Sudan's capital, Juba, along with a disputed stretch of border with Kenya.

At last abandoning imperial ambition in 1953, the British left Sudan to the tempest of regime rise-and-fall that tragically characterized post-colonial power vacuum in Africa.  The country declared itself independent in 1956, but for a quarter century, no one form of government would stick.  An Islamic state brought about some political consistency in 1983, but plenty of ills, too: reigniting civil war between north and south, and paving the path of three decades' dictatorship and an abysmal human rights record under President Omar al-Bashir, from 1989 to 2019.

Relations with the United States went from bad to worse after Sudan backed Iraq in the 1990-91 Gulf War.  Osama bin Laden took up residence in Khartoum for five years at that time.  He built a favorable reputation for philanthropy by building legitimate businesses and financing infrastructure projects, such as the main highway, named for him, linking Khartoum to Port Sudan.  In 1993, the United States listed Sudan as a state sponsor of terrorism.  Under U.S. pressure, Sudan expelled bin Laden in 1996.  But Sudan was not spared blame when al-Qaeda bombed the U.S. embassies in Tanzania and Kenya in 1998, killing 224 people, including 12 U.S. citizens, and injuring thousands.  U.S. retaliation included a cruise-missile strike against a Khartoum chemical plant—unfortunately and very likely a target accused erroneously of complicity in chemical weapons manufacture.

Ironically, the bin Laden-orchestrated terror attacks of September 11, 2001, set Sudan and the United States on a winding road of fits and starts toward reconciliation.  U.S. President George W. Bush recognized the need for American allies on the East African doorstep to the Middle East.  U.S. policy leveraged austere sanctions to incentivize Sudanese cooperation in counter-terrorism, and the Bashir regime was supportive.

Sudan needed help, too.  The civil war between the Islamic government in Khartoum and the Sudan People's Liberation Army (SPLA), started in 1983, had never ended.  The exhausting conflict, which ultimately cost more than 2 million civilian lives, was dragging into one of the longest civil wars in modern history—besides that it was really a sequel to the never-quite-resolved first Sudanese civil war of 1955 to 1972, another tragically typical consequence, in part, of arbitrary colonial political borders.  Multi-national diplomatic interventions helped at last to draw the war to a close in 2005.  The peace agreement led to the secession of South Sudan in 2011, a development that seemed promising at the time, but since has seen the two states teetering ceaselessly on the brink of combustion.

A spellbinding sampling of the human toll of the civil war can be found in Dave Eggers's What Is the What: The Autobiography of Valentino Achak Deng (2006).  Spanning events from 1983 to 2005, the book is an artfully novelized memoir of a real child refugee among Sudan's "lost boys."

In 2017, the Obama Administration further loosened sanctions on Sudan.  A coup in 2019 sent Bashir from office the same way he came in, and in 2020, Sudan reconstituted itself as a secular state.  Al-Bashir, 76, is now in prison for corruption.  Marking a significant policy reversal, the government has signaled that it might be willing to turn Bashir over to the International Criminal Court for prosecution in connection with the genocide in Darfur during the second civil war.  In October, the Trump administration moved to clear the way for U.S. businesses to reenter Sudan, bargaining the country's de-listing as a state sponsor of terrorism in exchange for Sudanese recognition of Israel.  The administration was accused of too-little-too-late effort to bolster its foreign policy portfolio in the run-up to the 2020 election, but, at this point, the end means more than the motive.

Persistent Perseverance

In short order, Sudan has transformed from war-torn religious state, ruled by a dictator accused of crimes against humanity, to secular constitutional democracy, pivotal in Middle East peace and primed for western commercial investment.  In other words, Sudan might be in the midst of a remarkably rapid transition from paradigmatic problematic state to African success story.

Long acquainted with the hardships of war and sanctions, the Sudanese have persevered, developing a resilient infrastructure and an enviable standard of living, especially relative to neighbors such as the CAR, the DRC, and Eritrea.  Sudanese teens wield smartphones in the dustiest of wayside villages.  Sudan has oil and refining capacity, though the division of natural resources between north and south remains a key cause of simmering contention.  The Khartoum skyline is dotted with structures infamously financed by deliberate defiance of sanctions.  Representative is the Corinthia Hotel: opened in 2008, the oval-shaped building is called "Gaddafi's egg," because Libya paid for its €80m construction.

At present, Sudan has one arm tied behind its back.  Trucks sit idle in fuel queues.  Western credit cards don't work; cash is king.  For better and worse, local products, mostly MENA-manufactured, substitute for the usual globalized glut of soda and snack options in the convenience stores, excepting the universe's inexplicably irreducible constant, Coca-Cola.

If sanctions go away, an energizing flow of auto parts, industrial equipment, transnational banking services, and development of telecommunication and physical infrastructure will irrigate Sudan's thirsty landscape.  The new constitutional government will be boosted to a threshold on prosperity unprecedented in the nation's history.  Already in June, the UK announced a £150m commitment to ease democratic transition and coronavirus impact by combating inflation and poverty.  Sudan unbound stands poised to achieve African development in a region that's long been starved of a win.

But There's a Hitch

Tort liability in U.S. courts is presently a sticking point in negotiations over normalization of U.S.-Sudanese relations and the entry of American enterprise in Sudan.  In 1996, Congress amended the Foreign Sovereign Immunities Act (FSIA) to allow civil lawsuits against foreign state actors for support of terrorism.  Survivors and families of victims of the 1998 embassy bombings sued Sudan in 2001.  The lawsuits floundered in the 20-aughts amid confusion over what plaintiffs, defendants, and causes of action Congress intended to authorize.  In 2008, Congress clarified the law on those questions and revived the earlier suits.

Subsequently, plaintiffs, numbering more than 700, won an award in federal court of $10.2bn, including $4.3bn in punitive damages.  The D.C. Circuit struck the punitive damages, doubting that Congress intended to authorize punitive recovery retroactively.  In May 2020, in Opati v. Republic of Sudan, the U.S. Supreme Court disagreed, vacating the striking of punitive damages and remanding for the lower courts to reconsider.  Litigation questions remain on remand.  The defense might yet challenge the constitutionality of the retroactive authorization of punitive damages, and it's not clear whether Congress intended foreign plaintiffs to be eligible for punitive awards.  Still, the massive compensatory award stands ripe for harvest.

All that litigation might, however, amount to naught if Congress acts again.  As a condition of the current agreement over sanctions and Israel, Sudan wants free of the Opati judgment.  In October, the State Department indicated willingness to negotiate immunity for Sudan against liability for past acts.  But that immunity would require another change of law, and Congress is not yet on board.

According to a report in Tuesday's New York Times, Sudan has offered a settlement of $335m, undoubtedly a more realistic number than multiple billions.  But Sudan has threatened to exit the agreement in whole if Congress doesn't authorize immunity by year's end.  Deadlocked legislators are trying to broker a compromise through a military spending bill in these first weeks of December.  To the displeasure of some in Congress, the working proposal would compensate U.S. citizens naturalized subsequently to the 1998 attacks less than those who were citizens at the time—working a de facto racial disparity.

Even if the 1998 claims can be resolved, a bigger hurdle looms in the prospect of blanket immunity-to-date for Sudan.  While Sudan did defend the embassy-bombing lawsuits on grounds of FSIA interpretation, it has not responded to the legal claims of, The Hill estimates, about 3,000 family members of September 11 victims who blame Sudan for bin Laden's five-year safe harbor there.  According to the New York Times story, those plaintiffs have the support of Senate leader Chuck Schumer (D-NY) to see that their claims are not extinguished.  It seems unlikely that a closely divided Congress would have any appetite to favor foreign tranquility over September 11 victims, no matter how much U.S. businesses are chomping at the bit to trade in Sudan.

Last Week in Sudan

Here in the United States, if we hear about Sudan, it's likely to be in the context of civil war atrocities, the human rights abuses of the Bashir regime, or Middle East tensions.  Yet last week in Sudan, I saw little evidence of those worldly matters.  On the roads of Khartoum, in the markets, and in the countryside, I found only a gracious and warm people, a rich Nubian cultural tradition, and a stunning archaeological record of our shared human heritage.

Both of those views, the ugly and the beautiful, the grim and the genial, are Sudan.  We disregard the former at our hazard.  But to disregard the latter, we risk much more.

Sudan is the beating heart of the African continent.  Sudan will not forever be deterred by colonial legacy and the politics of aging superpowers.  However we manage to balance redress for past wrongs with a way forward, America will have to decide how to be a part of Sudan's future.  The only alternative will be to join the crumbling desert relics of Sudan's past.

Peace, power at stake in elections around the world

With the U.S. election looming, it's easy to miss crucial elections going on elsewhere in the world, such as Ivory Coast and Moldova, with potential ramifications for global peace.

Votes are being counted now in the Ivory Coast presidential election.  Incumbent Alassane Ouattara is hoping for a third term despite vigorous opposition.  A 78-year-old economist, Ouattara has been president since 2011, after the disputed 2010 election resulted in civil war.  The Ivory Coast constitution limits a president to two terms, but the Ouattara side claims that a constitutional revision in 2016 reset the term clock.

An especially sensitive issue in the West African context, the dispute over term limits gives Ouattara's run an uncomfortable overtone of authoritarianism.  Ivory Coast is a key commercial player in West Africa, so stability or instability there ripples throughout the region.  One way or the other, the influence of Ivory Coast's outcome could be especially impactful as Mali, Burkina Faso, Niger, and western Nigeria all struggle to get a grip on lawlessness and violence in the western Sahel.

Meanwhile, voters are at the polls today in Moldova to choose between starkly different visions for the country's future.  Former socialist party leader Igor Dodon, president since 2016, faces former prime minister Maia Sandu in the country's fourth election since 1991 independence.  Dodon carries the endorsement of Russian President Vladimir Putin and resolves to look eastward for Moldova's future.  Sandu thinks the best hope to pull Moldova out of chronic economic stagnation lies westward, in the European model of development.

I wrote last year about my visit to the "breakaway state" of Transnistria, which embodies the depth of divide over Moldova's future.  Yet so much more is at stake; Moldova stands as a bellwether for the region, indicative of future European or Russian influence.  And with Brexit occurring on Europe's opposite border, the continental union's prospects for eastern growth might speak to the future of the union itself.

Both elections, in Ivory Coast and Moldova, are plagued with reports and denials of poll tampering and improper influence over voters.  And people in both countries fear for the peace in the wake of an outcome favoring any side.

Even these elections are not the only ones in the world right now.  The "Georgian Dream" party looks to have won third-term control of Georgia's parliament, lengthening a long-term one-party rule there that opponents say has failed to deliver economic prosperity for working people.  And today, voters in Algeria, where I also visited in 2019, opine on anti-corruption constitutional reforms hoped to quell protests that persisted after the 2019 election of presidential challenger Abdelmadjid Tebboune failed to deliver the prompt changes that the street wanted.

The American election is only one among many in the world this fall in which prosperity and peace might hang in the balance.  I'm hoping that whatever happens here on November 3, we model order and rationality.

UK football letter roils world sport, and real world, too

The English Premier League football (soccer) organization wrote to the U.S. Trade Representative in February urging that the United States put the Kingdom of Saudi Arabia on the "Priority Watch List" of countries that fail to protect intellectual property (IP) rights.

The letter has been widely reported beyond the football world for its potential implications in foreign affairs.  Where the United States is concerned, IP piracy is regarded as a critical contemporary problem, on par with national security.  Much of that regard is warranted, as countries such as China, at least historically, have been linked to IP theft as a means to unfair economic advantage, to the detriment of American enterprise.  Some of the sentiment derives from the capture of Washington by IP-wealthy corporations, to the detriment of intellectual freedom.  Regardless, the gross result has been a paper war with nations that countenance IP piracy.  To put Saudi Arabia in those U.S. crosshairs adds a layer of complexity to our already impossibly complicated love-hate relationship with the KSA—read more from James Dorsey just last week—with ramifications from Yemen to Israel.

The letter has potential ramifications within the Middle East, too.  The Premier League's indictment calls out specifically a Saudi-based pirate football broadcaster that calls itself "beout Q" and seems to operate in a blind spot of Saudi criminal justice, even distributing set-top boxes and selling subscriptions in Saudi retail outlets.  The name seems to be a thumb in the nose of beIN Sports, a Doha-based, Qatari-owned media outlet with lawful licensing rights to many Premier League and other international sporting matches.  Saudi Arabia has led the blockade of Qatar since the 2017 Middle East diplomatic crisis, a high note of previously existing and still enduring tensions between the premier political, economic, and cultural rivals in the region.

Football and international sport are weapons in this rivalry.  Qatar has long capitalized on sport as a means to the end of soft international power, winning the big prize of the men's football World Cup in 2022, if by hook or by crook.  Saudi Arabia has more lately taken to the idea of "sportwashing" its image, especially since the Jamal Khashoggi assassination and amid the ceaseless civil war in Yemen.

The letter roiled the world of football no less, as Saudi Arabia has been in negotiation to acquire the Newcastle United Football Club.  That purchase requires Premier League approval.  So everyone and her hooligan brother has an opinion about what it means that the league is so worked up about Saudi IP piracy as to write to the United States for help.

This unusual little letter is a reminder of a theme, known to social science and as old as the Ancient Olympics, that, more than mere diversion, sport is a reflection of our world.

Informe costarricense mixto sobre libertad de expresión: tribunales presionan por transparencia; ley se mueve contra discurso de odio, desinformación

Desde la perspectiva norteamericana, Costa Rica ha sido aclamada durante mucho tiempo como un modelo de democracia en las Américas. Eso es lo que me llevó a enfocarme en Costa Rica para estudios universitarios en periodismo comparativo, y fue así que desperté un amor por el país. Es importante destacar que San José opera como la sede de la Corte Interamericana de Derechos Humanos. La afinidad de Costa Rica con los Estados Unidos se remonta en los tiempos modernos a la transformadora y ahora legendaria primera presidencia de Óscar Arias en la década de 1980 (sin dejar de mencionar las recientes acusaciones, e.g., Time). Si hoy es cierto, en algún sentido, que Costa Rica está a la vanguardia de los derechos humanos regionales, entonces vale la pena ver los acontecimientos en Costa Rica como un referente.

Un nuevo informe exhaustivo sobre la libertad de expresión y la libertad de información en Costa Rica ha sido emitido por el Programa de Libertad de Expresión y Derecho a la Información y el Centro de Investigación de Comunicación de la Universidad de Costa Rica (HT@ Observacom). En general, este informe revela un sistema legal que lucha con problemas que son familiares en otros países—por ejemplo, el acceso público y periodístico a las plataformas de redes sociales cuando un político aparentemente elige hacer negocios allí. Un informe de este tipo no es único en las Américas (mira, e.g., México 2019), y este no es el primero de Costa Rica; admito que me atrajo debido a la coincidencia de algunos problemas que me interesan, incluso colegiación de periodismo, mencionados a continuación.

El primer capítulo del informe (y el único que he leído) está escrito por la abogada, periodista, y académica, Giselle Boza Solano. Boza concluye con preocupación que no ha habido movimiento legislativo en Costa Rica para garantizar la proliferación de las diversas voces en la era de internet, donde el mercado del discurso y la elaboración de la política del habla están cada vez más dominados por los grandes proveedores de servicios, como Google. Su preocupación está sincronizada con los movimientos en Europa, con Francia a la cabeza, y en América Latina, con Uruguay como organizador. Costa Rica parece ser próximo en esta lista. Sin embargo, Boza, y el informe, reconocen y examinan las iniciativas para financiar los esfuerzos cinematográficos y audiovisuales con un impuesto a las plataformas digitales y la televisión por suscripción.

Además, me anima el comentario de Boza sobre la jurisprudencia costarricense. Si la selección es indicativa, los tribunales, en la mayor parte, parecen mantenerse a la par con su compromiso histórico con las libertades de expresión e información. En el área de libertad de información, el Tribunal Constitucional dictó decisiones que facilitan el acceso electrónico a datos meteorológicos y el registro electrónico de la policía en lugares públicos. Los tribunales dictaron decisiones que facilitaron el acceso de los ciudadanos al proceso legislativo y a la legislación. La inclinación por los legisladores a retirarse a la oscuridad en nuestros tiempos difíciles parece ser una norma universal.

El Tribunal Constitucional también reprendió al Colégio de Periodistas por afirmar una provincia exclusiva sobre el derecho a llamarse a sí mismo periodista, ante la queja de un periodista digital sin el título universitario, como se requiere. El tribunal reiteró la consecuente opinión consultiva de la Corte Interamericana de Derechos Humanos de 1985, incluso antes de que el periodismo digital existiera propiamente. Es bastante sorprendente que esto todavía sea algo que deba adjudicarse 35 años después. (Escribí sobre este caso cuando era estudiante en 1993 y, para ser justo, la situación es un poco más complicada de lo que parece en la superficie. Aún así….)

Hay motivos de preocupación más allá de la falta de impulso para la libertad de internet. El proyecto de ley mejoraría o aplicaría el castigo penal por el discurso de odio y la difusión de desinformación ("noticias falsas"). Tales leyes se encontrarían en conflicto contra la libertad de expresión. Costa Rica ciertamente no es el único país con tales propuestas sobre la mesa, pero, nuevamente, esto es problemático en una democracia de vanguardia.

Eso es solo el capítulo 1. El informe presenta un análisis cuantitativo de la autopercepción de los medios, y, también, capítulos sobre publicidad, violencia contra las mujeres en las noticias, y más. Multidisciplinary 'Law and Development' book tackles hard problems from principled perspectives

I am thrilled to announce the publication of Law and Development: Balancing Principles and Values, from Springer, a publication in the Kobe University Monograph Series in Social Science Research (flyer). While I was privileged to serve as a contributor and co-editor, with Professor Dai Tamada (law site), of Kobe University in Japan, this book has been a project of passion for our lead editor, my inspiring colleague and friend, Professor Piotr Szwedo. On the law faculty of the Jagiellonian University (UJ) in Poland, Professor Szwedo serves as head of the OKSPO Center for Foreign Law Schools and co-director of UJ law programs with the Columbus School of Law at The Catholic University of America, and the Université d’Orléans.

Born of an international conference organized by Professor Szwedo at UJ, this ambitious multidisciplinary collection examines the problem of "development" across the world especially from perspectives informed by morality and ethics. Here is the jacket précis:

This book examines the concept of ‘development’ from alternative perspectives and analyzes how different approaches influence law. ‘Sustainable development’ focuses on balancing economic progress, environmental protection, individual rights, and collective interests. It requires a holistic approach to human beings in their individual and social dimensions, which can be seen as a reference to ‘integral human development’ – a concept found in ethics. ‘Development’ can be considered as a value or a goal. But it also has a normative dimension influencing lawmaking and legal application; it is a rule of interpretation, which harmonizes the application of conflicting norms, and which is often based on the ethical and anthropological assumptions of the decision maker. This research examines how different approaches to ‘development’ and their impact on law can coexist in pluralistic and multicultural societies, and how to evaluate their legitimacy, analyzing the problem from an overarching theoretical perspective. It also discusses case studies stemming from different branches of law.

Book chapter examines information access in context of Polish privatization, law and development

My colleague Gaspar Kot and I have published a book chapter entitled Private-Sector Transparency as Development Imperative: An African Inspiration.  The chapter appears in the new book, Law and Development: Balancing Principles and Values, from Springer, edited by Professors Piotr Szwedo, Dai Tamada, and me (more in the next entry on this blog).  Here is our abstract:
Access to information (ATI) is essential to ethical and efficacious social and economic development. Transparency ensures that human rights are protected and not overwhelmed by profiteering or commercial priorities. Accordingly, ATI has become recognised as a human right that facilitates the realisation of other human rights. But ATI as conceived in Western law has meant only access to the state. In contemporary development, private actors are crucial players, as they work for, with, and outside the state to realise development projects. This investment of public interest in the private sector represents a seismic shift in social, economic, and political power from people to institutions, akin to the twentieth-century creation of the social-democratic state.
Contingent on state accountability, Western ATI law has struggled to follow the public interest into the private sector. Western states are stretching ATI law to reach the private sector upon classical rationales for access to the state. In Poland, hotly contested policy initiatives over privatisation and public reinvestment have occasioned this stretching of ATI law in the courts. Meanwhile, in Africa, a new model for ATI has emerged. Since the reconstruction of the South African state after Apartheid, South African ATI law has discarded the public-private divide as prohibitive of access. Rather than focusing on the nature of a private ATI respondent’s activity as determinative of access, South African law looks to the demonstrated necessity of access to protect human rights.
This chapter examines cases from South Africa that have applied this new ATI model to the private sector in areas with development implications. For comparison, the article then examines the gradually expanding but still more limited Western approach to ATI in the private sector as evidenced in Polish ATI law. This research demonstrates that amid shifting power in key development areas such as energy and communication, Polish courts have been pressing ATI to work more vigorously in the private sector upon theories of attenuated state accountability, namely public ownership, funding, and function. We posit that Poland, and other states in turn, should jettison these artifices of state accountability and look instead to the South African model, since replicated elsewhere in Africa, for direct access to the private sector. ATI law should transcend the public-private divide, and the nations of the North and West should recognise human rights as the definitive rationale for ATI in furtherance of responsible development.

With Mr. Kot's help, this chapter extends to a European context my previously published comparative work on private-sector information access. Gaspar's expertise was invaluable for Polish legal research, to be sure, but moreover to help me to understand Poland's richly complex, on-again-off-again courtship of privatization.

In earlier works, I compared the South African approach with the United States FOIA and with Indian RTI law.  I am excited about this approach in access-to-information law, which is now gaining traction elsewhere in Africa, because I believe it to be a potential game-changer in saving democracy and human dignity from corporatocracy. I am spending some of my sabbatical time this semester in Africa and other parts of the developing world studying how this approach is especially salient in the context of problems in social and economic development.

Happy Independence Day, Namibia!

Yesterday, March 21 was independence day in Namibia. One of the youngest countries in the world, Namibia attained independence from South Africa in 1990 after a brutal war and bloody history of subjugation as the German colony of Southwest Africa. Public celebrations of 30 years of independence were cancelled because of the coronavirus, though an inauguration ceremony of President Hage Geingob, for his second term, proceeded.

I found mixed feelings on the ground about Geingob, who was the country's first prime minister and a hero of the independence movement. One middle-aged man from Namibia's rural north told me Geingob can't be blamed for entrenched intransigence and corruption in the political establishment, that he can only do so much. Meanwhile a young woman in the capital, Windhoek, stringing together multiple jobs to put herself through university, blamed Geingob squarely for double-digit unemployment--by various estimates, one in three Namibians, or more, need work--and fiercely lamented his second term.

I've been sensitive in traveling Africa to the subtleties of foreign influence, especially that of China, and that shadow turned up in a curious way in Namibia. Like elsewhere in Africa (I wrote earlier about Guinea-Bissau), communists financed the independence movement as an aspect of the Cold War; consider, for Namibia, this was the 1980s. North Korea grew close to legendary independence leader Sam Nujoma. North Korea financed a great many public works projects in independent Namibia, including recently and strikingly, the National Museum, which opened in Windhoek in 2014. The building is modernist (technically "socialist realist"), marking a contrast with Windhoek's colonial center, and boasts a Kim Jong-ish statue of Nujoma. The interior is to match, celebrating Namibian independence with socialist-style murals and cult-of-personality-type homages to national leaders.

Why does North Korea's interest persist so many years after independence? Locals point to Namibia's especially valuable natural resource: uranium mines in the western Namib desert. Though North Korea formally is walled off by the West from materials that might advance the DPRK's nuclear capabilities, suspicions point to China as a willing intermediary. And so the African "natural resources curse" persists.

Customary law undergirds justice systems in Africa: A-courting in Harare

The integration of customary law into national legal systems based on post-colonial polities is a challenge, and an opportunity, throughout Africa. I wrote recently about customary legal authority in the Casamance region of Senegal, and Zimbabwe is no exception to the norm.

The Zimbabwe constitution expressly preserves customary law, and federal enactments spell out the scope of customary law in sensitive areas, such as marriage and child care. The constitution creates customary courts and charges other courts, including the Supreme Court, with respecting and developing customary law, just as they do common law. For NYU Law GlobaLex, Saki and Chiware (updated by Pfumorodze and Chitsove, 2017) further explained:
The main reason for the existence of these customary law courts is to provide a justice system to ordinary people in rural areas which is consistent with African custom and values.  It is  realized that most ordinary Zimbabweans regulate their lives in accordance with customary law to the extent that the legal ideas and institutions inherited from the system has  preserved the authority of traditional leaders  to adjudicate in civil disputes by customary law.
In Zimbabwe, customary courts have jurisdiction over civil, but not criminal, matters. Common law controls in the civil sphere, while criminal law is strictly codified in Zimbabwe's mixed system.
